The gazette notification was released on Monday night (1 December) by the Legislative and Parliamentary Affairs Division of the Law Ministry. Earlier, on 6 November, the Advisory Council had given final approval to the draft.
Under the new ordinance, special tribunals titled Enforced Disappearance Prevention and Remedy Tribunals will be established at both district and divisional levels. Offences under this ordinance are non-bailable and cannot be settled out of court.
According to the ordinance, if any government official or member of a law enforcement agency arrests, detains, abducts, or unlawfully confines a person and later denies involvement, or conceals the victim’s fate, whereabouts, or condition—thereby depriving the person of legal protection—the act will be treated as an enforced disappearance and a criminal offence. The offender may face life imprisonment or a maximum of 10 years in jail.
If the victim dies as a result of the disappearance, or if the person cannot be recovered alive or dead even after five years, the responsible individual may be sentenced to death or life imprisonment.
The ordinance further states that destroying evidence of enforced disappearance or building, maintaining, or using secret detention centres for the purpose of disappearance may result in up to seven years’ imprisonment.
Strict liability has also been introduced for higher-ranking officers. If a commanding officer or superior instructs, approves, permits, encourages, or directly participates in such crimes committed by subordinates, they will face the same punishment prescribed for the primary offence.
Senior officials may also be punished if their negligence or incompetence allows their subordinates to engage in such acts. Failure to maintain discipline or properly supervise subordinates, resulting in the commission of enforced disappearances, will also make the superior liable for the original offence.
The ordinance additionally allows the state to keep the location of an arrested person confidential until they are produced before a magistrate, citing “national security” considerations. Trials may proceed in absentia if the accused remains absconding.

গুম প্রতিরোধ ও প্রতিকার নিশ্চিত করতে রাষ্ট্রপতি ‘গুম প্রতিরোধ ও প্রতিকার অধ্যাদেশ, ২০২৫’ জারি করেছেন। এতে গুমের দায়ে মৃত্যুদণ্ড ও যাবজ্জীবন কারাদণ্ডের মতো সর্বোচ্চ সাজা অন্তর্ভুক্ত করা হয়েছে।
সোমবার (১ ডিসেম্বর) রাতে আইন মন্ত্রণালয়ের লেজিসলেটিভ ও সংসদ বিষয়ক বিভাগ থেকে এ সংক্রান্ত গেজেট প্রকাশ করা হয়। এর আগে ৬ নভেম্বর উপদেষ্টা পরিষদ অধ্যাদেশের খসড়ার চূড়ান্ত অনুমোদন দেয়।
অধ্যাদেশ অনুযায়ী জেলা ও বিভাগীয় পর্যায়ে ‘গুম প্রতিরোধ ও প্রতিকার ট্রাইব্যুনাল’ গঠন করা হবে। এই আইনের অধীনে করা অপরাধ জামিনযোগ্য নয় এবং আপসের সুযোগও থাকবে না।
অধ্যাদেশে বলা হয়েছে, কোনো সরকারি কর্মকর্তা বা আইনশৃঙ্খলা বাহিনীর সদস্য কাউকে গ্রেফতার, আটক, অপহরণ বা স্বাধীনতা হরণের পর বিষয়টি অস্বীকার করলে, কিংবা ভুক্তভোগীর অবস্থান, অবস্থা বা পরিণতি গোপন রাখলে এবং এতে ব্যক্তির আইনগত সুরক্ষা ক্ষুণ্ণ হলে তা ‘গুম’ হিসেবে গণ্য হবে। এ ধরনের অপরাধে যাবজ্জীবন কারাদণ্ড বা সর্বোচ্চ ১০ বছরের কারাদণ্ড হতে পারে।
গুমের ফলে যদি কোনো ব্যক্তির মৃত্যু ঘটে, অথবা পাঁচ বছর পরও তাকে জীবিত বা মৃত অবস্থায় পাওয়া না যায়, তাহলে দায়ী ব্যক্তির মৃত্যুদণ্ড বা যাবজ্জীবন কারাদণ্ডের বিধান প্রযোজ্য হবে।
এ ছাড়া গুমের প্রমাণ নষ্ট করা বা গোপন আটককেন্দ্র তৈরি, রক্ষণাবেক্ষণ বা ব্যবহার করলে সর্বোচ্চ সাত বছরের কারাদণ্ড হতে পারে।
অধ্যাদেশে বাহিনীর ঊর্ধ্বতন কর্মকর্তাদের জন্যও দায় নির্ধারণ করা হয়েছে। কোনো কমান্ডার বা ঊর্ধ্বতন কর্মকর্তা অধস্তনদের এমন অপরাধে নির্দেশ, অনুমোদন, সম্মতি বা প্ররোচনা দিলে, কিংবা নিজে এতে অংশ নিলে তিনি মূল অপরাধের সমান শাস্তির মুখোমুখি হবেন।
তদারকির ব্যর্থতা, অবহেলা বা অদক্ষতার কারণে অধস্তনরা গুমের মতো অপরাধে জড়ালে ঐ ঊর্ধ্বতন কর্মকর্তাকেও দায়ী করা হবে। শৃঙ্খলা রক্ষা ও পর্যবেক্ষণে ব্যর্থতার ফলে অপরাধ সংঘটিত হলে একই সাজা প্রযোজ্য হবে।
অধ্যাদেশে আরও বলা হয়েছে, গ্রেফতার ব্যক্তিকে ম্যাজিস্ট্রেটের সামনে হাজির করার আগ পর্যন্ত ‘রাষ্ট্রীয় নিরাপত্তার স্বার্থে’ তার অবস্থান গোপন রাখা যেতে পারে। আর অভিযুক্ত ব্যক্তি পলাতক থাকলে তার অনুপস্থিতিতেও বিচার প্রক্রিয়া সম্পন্ন করা যাবে।
